INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

 

Please read this form carefully and be aware that in using the Town of Merrill facilities you and your organization will be waiving and releasing all claims for injuries that you or your members might sustain.

 

ACKNOWLEDGEMENT OF RISK OF INJURY CLAUSE:

I/We and the group I represent, acknowledge that there are certain risks of physical injury that may arise in connection with our use of the Town of Merrill facilities.  I/We agree to assume the full risk of injuries, including death, damages, or loss, which I/we may sustain as a result of participating in any and all activities connected with our use of the Town of Merrill facilities.

 

WAIVER OF CLAIM FOR INJURY CLAUSE:

I/We agree to discharge, waive, and relinquish the Town of Merrill officers, agents, and employees of all claims, demands, damages, rights or courses of action, present or future, which I/we may have as a result of the use or intended use of the facilities.

 

RELEASE FROM LIABILITY CLAUSE:

I/We fully release and discharge the Town of Merrill and its officers, agents, and employees from any and all claims for injuries, including death, damage, or loss which I/we may have or which may accrue to me/us on account of my/our use or intended use of the facilities.

 

INSURANCE:

If requested by the Town Board, I/we shall provide proof of liability insurance covering my/our use of Town of Merrill facilities, and also if requested, name the Town of Merrill as an additional insured on such policy.

 

INDEMNITY AND DEFENSE CLAUSE:

I/We further agree to indemnify and hold harmless and defend the Town of Merrill and its officers, agents, and employees from any and all claims resulting for injuries, including death, damages, and losses sustained by me/us and arising out of, connected with, or in any way associated with the use or intended use of the facilities, and further agree to reimburse and pay the Town of Merrill costs, including without limitation, attorney’s fees for investigating, defending, and/or resolving any claim that may be made against the Town of Merrill, and/or its officers, agents, and employees arising out of or in any way connected with my/our use of the Town of Merrill facilities and equipment.

PROCEDURES AND RULES FOR FACILITY RENTAL

 

Individuals and organizations wishing to use the Town of Merrill facilities shall:

 

1.     Complete a Rental Agreement Form & Indemnification & Hold Harmless Agreement.

 

2.     Submit the required fee and security deposit upon acceptance by the Town.

 

3.     Accept the rental hours of operation as 7:00 am until 12:00 am midnight.

 

4.     Use only approved decorations and hangers provided. Do not use any mounting screws, tacks, tape, or nails of any kind. Glitter of any kind is strictly prohibited. Use of glitter will result in loss of security deposit.

 

5.     No smoking is allowed in the building. Smoking is allowed outside in designated areas.

 

6.     Provide sufficient adult supervision, a person 21 years or older, at all times.

 

7.     Do not stand or sit on tables and do not stand on chairs.  Do not remove tables, chairs, or any other town property from the hall.  Do not take any furnishings outside.

 

8.     Clean and restore facilities to a least as good as condition as they were when usage began.  Remove all trash inside and outside of building that is created by your function and place it in the container provided.  The security deposit will be withheld accordingly if there is damage to the facility, missing town property, or significant cleaning required.

 

9.     Park only in designated areas.

 

10.                         Alcoholic beverages are allowed, but are subject to state and local ordinances.  A bartender licensed in the State of Wisconsin is required if alcohol or liquor is sold at an event. This is the responsibility of the person that signed the rental agreement.

 

11.                         The cancellation policy for cancellation of a rental is as follows:

 

a.     Full refund of the rental fee and security deposit will be given if a written notice of cancellation is received 6 months or more prior to the rental date.

b.     A refund of the rental fee will be given if written notice of cancellation is received 4-6 months prior to the rental date. The entire security deposit will be forfeited.

c.      Written notice of cancellation received less than 120 days prior to the rental date will result in a complete forfeiture of the rental fee AND security deposit.

d.     The date the written notice of cancellation is received by the Town of Merrill will be the official date of cancellation.

 

12.                         No pets allowed on the premises.

Town of Merrill Community Center Rental Fee Schedule

Town of Merrill Resident: $150/day/event

Town of Merrill Resident Security Deposit: $150

 

Non-Resident Fee: $200/day/event

Non-Resident Security Deposit: $200

  

Wedding - Town of Merrill Resident: $350

Wedding - Town of Merrill Resident Security Deposit: $400

 

Wedding - Non-Resident Fee: $400

Wedding - Non-Resident Security Deposit: $400

 

**If the facility is rented for a wedding, it may be rented the day before/after at the following rates, regardless of residency:

 

Day prior - Noon until Midnight: $75

Day after - 7 am until 5 pm: $100

 

Seminar/Expo: $400 (No Discount Applies)

Seminar/Expo Security Deposit: $400

 

Wedding/Baby Showers: $75

*4-Hour Rental

*Less than 50 people

 

Meetings: $10/hour (no use of kitchen)

 

Rates are subject to change and review by the Merrill Town Board. The Town Board has final approval on all applications submitted. The Town of Merrill reserves the right to check attendance/events.

 

Rental dates are not guaranteed until full payment, including event fee and security deposit, indemnification agreement, and rental agreement have been received.  The community center is rented on a first-come, first-served basis.  Neither a phone call or incomplete paperwork will “hold” the date.
